These Terms of Service ("Terms") govern your access to and use of Dating Advice, including datingadvice.me and the related websites, applications, features, artificial intelligence features, content, and services we make available (collectively, the "Service").
Dating Advice is operated by Nex Gen Digital Services LLC, a Wyoming limited liability company ("Dating Advice," "we," "us," or "our").
By creating an account, accessing or using the Service, purchasing a subscription, or otherwise indicating your acceptance of these Terms, you agree to be bound by these Terms and our Privacy Policy.
If you do not agree, do not use the Service.
You must be at least 18 years old to use Dating Advice.
By using the Service, you represent and warrant that you are at least 18 years old and have the legal capacity to enter into these Terms.
We do not knowingly offer the Service to children or minors.
Dating Advice is an AI-powered conversational service designed to help users talk through dating, relationships, communication, breakups, boundaries, interpersonal situations, personal reflections, and related topics.
Dating Advice is a conversational and informational tool. It is not a human adviser, therapist, counselor, physician, attorney, financial adviser, emergency service, crisis service, or other licensed professional service.
The Service is not intended to establish a therapist-patient, physician-patient, attorney-client, fiduciary, professional coaching, or other professional relationship.
Dating Advice uses artificial intelligence to generate responses.
AI-generated responses may be inaccurate, incomplete, outdated, misleading, inappropriate, offensive, or unsuitable for your particular circumstances. AI may misunderstand your message, make incorrect assumptions, fail to recognize important context, or generate information that appears convincing but is wrong.
Responses are generated algorithmically and should not be treated as statements of fact merely because they are presented confidently or conversationally.
You should independently evaluate information that is important to your health, safety, finances, legal rights, relationships, or other significant decisions.
AI-generated responses may not be unique. Other users may receive identical or similar responses.
You remain solely responsible for your decisions, actions, communications, conduct, and use of information obtained through Dating Advice.
Dating Advice does not make decisions for you.
You understand that use of or reliance upon AI-generated content is at your own discretion and risk. You are responsible for evaluating whether any response is appropriate for your circumstances before acting or declining to act based upon it.
To the fullest extent permitted by applicable law, you assume the risks associated with relying upon AI-generated information or conversational guidance.
Nothing in these Terms excludes or limits any responsibility or liability that cannot lawfully be excluded or limited.
The Service does not provide medical, mental-health, psychological, legal, financial, investment, or other regulated professional advice.
Do not delay seeking qualified professional assistance because of something generated by Dating Advice.
When a situation involves important health, safety, legal, financial, or other professional considerations, you should consult an appropriately qualified professional.
Dating Advice is not an emergency or crisis-response service.
The Service does not continuously monitor conversations and cannot guarantee that it will identify statements indicating self-harm, suicide, abuse, violence, danger, medical emergencies, or other crises.
Dating Advice cannot contact emergency responders, physically intervene, perform a welfare check, guarantee notification of another person, or ensure your safety.
If you believe that you or another person may be in immediate danger, experiencing a medical emergency, considering suicide or serious self-harm, or facing an urgent threat of violence, contact appropriate local emergency or crisis resources or a trusted person who can provide immediate real-world assistance.
Do not rely on Dating Advice as your sole source of assistance in an emergency or crisis.
Certain features require an account.
You agree to provide accurate information where requested and to maintain the security of your account credentials.
You are responsible for activity occurring through your account except to the extent caused by circumstances for which applicable law makes us responsible.
You may not impersonate another person, create accounts through fraudulent means, or use another person's account without authorization.
We may provide limited free access to some features.
Free-message allowances, feature availability, usage limits, models, functionality, and other aspects of free access may be modified, suspended, or discontinued at any time.
The availability of free access does not guarantee that any particular free feature or allowance will remain available.
Dating Advice may offer a paid recurring subscription ("Pro").
The price, billing interval, and material subscription terms will be displayed before purchase.
By purchasing Pro, you authorize the applicable payment processor to charge the payment method you provide on a recurring basis at the disclosed subscription price, plus applicable taxes, until you cancel.
Subscriptions automatically renew unless canceled before the applicable renewal is processed.
We may change subscription pricing prospectively. Where required, we will provide notice before a price change takes effect for an existing subscription.
You may cancel Pro through the available subscription or account controls.
Cancellation prevents future renewals but does not automatically delete your Dating Advice account, conversations, or account history.
We recommend canceling before your scheduled renewal date.
If a renewal payment has already been submitted or processed before your cancellation takes effect, cancellation does not automatically reverse that payment.
We offer a 14-day money-back guarantee on your initial paid subscription purchase. If you are dissatisfied with the service, you may request a refund within 14 calendar days of your first payment.
This voluntary money-back guarantee applies only to your initial subscription payment and does not restart when your subscription renews.
Subscription renewal payments are generally nonrefundable, except where required by applicable law or where a refund is approved under Paddle's policies.
You may cancel your subscription at any time to prevent future renewal charges. Cancellation does not automatically refund payments already processed.
Nothing in this policy limits your statutory consumer rights, including applicable withdrawal rights or remedies for defective services.
To request a refund, visit paddle.net. If you need assistance, contact support@datingadvice.me. Refunds are processed by Paddle, our payment provider.
Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns.
Payment, billing, taxes, cancellations, and refunds for purchases are also governed by Paddle's Buyer Terms.
Payment providers may collect and process payment-card, billing, tax, fraud-prevention, and transaction information according to their own terms and privacy practices.
Dating Advice does not need to directly possess your complete payment-card information in order to provide the Service.
Deleting your account is different from canceling Pro.
When you request account deletion through the available account controls, Dating Advice will remove the account information, conversations, messages, and uploaded content associated with the account from the active Service, subject to legitimate technical, backup, security, legal, fraud-prevention, and third-party retention requirements described in our Privacy Policy.
Account deletion is intended to be permanent and may not be reversible.
Deleting an account with an active subscription will initiate cancellation of the associated subscription where supported by our payment integration. You remain responsible for charges already submitted or processed, subject to applicable law.
"User Content" includes messages, text, images, screenshots, photographs, audio, transcripts, prompts, and other material you submit through the Service.
You retain whatever ownership rights you have in your User Content.
You grant us a limited, non-exclusive license to host, store, reproduce, transmit, process, display, and otherwise use User Content as reasonably necessary to operate, secure, maintain, improve, and provide the Service and its features, including processing through service providers.
This license does not give us ownership of your User Content.
You represent that you have the rights necessary to submit User Content and that your submission and our permitted processing of it do not unlawfully violate another person's rights.
Dating and relationship conversations can contain highly personal information.
You control what you choose to submit. You do not need to provide unnecessary names, addresses, telephone numbers, usernames, account credentials, financial information, or other identifying information merely to discuss a situation.
If you upload screenshots, photographs, messages, or other material involving another person, consider removing information that is unnecessary for the conversation.
You are responsible for ensuring that your submission of third-party information is lawful.
You may not use Dating Advice to:
We may investigate suspected misuse and take reasonable action to protect users, the Service, third parties, or our rights.
Dating Advice Pro includes unlimited conversations for personal, non-commercial use by one individual. To keep the Service reliable for everyone, we apply automated limits on how quickly messages and voice requests can be sent and allow one reply to be generated at a time per account. Requests that fail or are refused by these limits do not count against your free replies. We may temporarily slow or pause access for activity that appears automated, shared among multiple people, resold, or otherwise abusive. These measures do not cap the total number of messages available in normal personal use, and we will not suspend an account solely because of high usage without first reviewing it.
Except for User Content and third-party materials, the Service and its associated software, interfaces, designs, branding, text, graphics, functionality, and other proprietary materials are owned by or licensed to Nex Gen Digital Services LLC and are protected by applicable intellectual-property laws.
Subject to these Terms, we grant you a limited, personal, non-exclusive, non-transferable, revocable right to access and use the Service for lawful personal purposes.
No ownership interest in the Service is transferred to you.
If you voluntarily provide suggestions, ideas, comments, or feedback about Dating Advice, you grant us the right to use that feedback without restriction or compensation to you, provided that doing so does not give us ownership of your private conversations or other User Content merely because they contain feedback.
Our collection and processing of personal information are described in our Privacy Policy.
Providing the Service may require information to be processed by third-party providers that support hosting, authentication, storage, artificial intelligence, voice functionality, payments, security, and related infrastructure.
Please review the Privacy Policy before using Dating Advice.
Dating Advice relies on third-party technologies and service providers.
Those providers may experience outages, errors, security incidents, policy changes, service changes, or other events outside our control.
We do not guarantee the continued availability of any particular third-party provider, AI model, feature, integration, or technology.
Where appropriate, we may replace, add, remove, or modify providers and technologies used to operate the Service.
We may add, modify, suspend, restrict, or discontinue features or portions of Dating Advice.
We may also impose or modify usage limits where reasonably necessary for security, cost management, reliability, legal compliance, product development, or operation of the Service.
Where required by applicable law, we will provide appropriate notice of material changes affecting paid services.
We may suspend or terminate access to the Service where reasonably necessary because of:

WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, COMPLETELY SECURE, OR THAT AI-GENERATED RESPONSES WILL BE ACCURATE, COMPLETE, APPROPRIATE, SAFE, OR SUITABLE FOR YOUR PARTICULAR CIRCUMSTANCES.
SOME JURISDICTIONS DO NOT ALLOW CERTAIN WARRANTY DISCLAIMERS, SO SOME OF THE ABOVE MAY NOT APPLY TO YOU.
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, NEX GEN DIGITAL SERVICES LLC AND ITS AFFILIATES, MEMBERS, MANAGERS, OFFICERS, EMPLOYEES, CONTRACTORS, AGENTS, AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, PUNITIVE, OR CONSEQUENTIAL DAMAGES, OR FOR LOSS OF PROFITS, REVENUE, DATA, GOODWILL, BUSINESS OPPORTUNITY, OR OTHER INTANGIBLE LOSSES ARISING FROM OR RELATING TO THE SERVICE.
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, THIS INCLUDES CLAIMS ARISING FROM OR RELATING TO:

THE LIMITATIONS IN THESE TERMS DO NOT APPLY TO LIABILITY THAT CANNOT LAWFULLY BE EXCLUDED OR LIMITED. YOUR JURISDICTION MAY PROVIDE RIGHTS OR REMEDIES THAT CANNOT BE WAIVED BY CONTRACT.
To the fullest extent permitted by applicable law, you agree to indemnify and hold harmless Nex Gen Digital Services LLC and its affiliates, members, managers, officers, employees, contractors, and agents from third-party claims, liabilities, damages, judgments, losses, and reasonable costs arising from your unlawful User Content, your material violation of these Terms, your infringement or violation of another person's rights, or your unlawful or intentional misuse of the Service.
This obligation does not require you to indemnify us for our own unlawful conduct or for liability that applicable law does not permit us to shift to you.
These Terms and disputes arising from or relating to them or the Service are governed by the laws of the State of Wyoming, without regard to conflict-of-laws principles, except to the extent applicable law requires otherwise.
Nothing in these Terms deprives you of mandatory consumer protections that apply to you and cannot lawfully be waived by contract.
Wyoming law governs the internal affairs of Nex Gen Digital Services LLC as provided by applicable Wyoming law.
Before initiating arbitration, either you or Dating Advice must send the other a written notice describing the dispute and requested resolution.
Notices to Dating Advice must be sent to:
The parties agree to make a good-faith effort to resolve the dispute informally for 30 days after receipt of the notice before initiating arbitration, unless applicable law requires otherwise or immediate relief is necessary to prevent imminent and irreparable harm.
The notice should contain sufficient information to identify the relevant account, describe the nature of the dispute, and explain the requested resolution.
PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS.
Except for disputes eligible for small claims court, requests for certain temporary or preliminary injunctive relief, and disputes that applicable law does not permit to be arbitrated, you and Nex Gen Digital Services LLC agree that disputes arising out of or relating to these Terms, Dating Advice, or the relationship between you and Dating Advice will be resolved through binding individual arbitration rather than in court.
Arbitration will be administered by the American Arbitration Association ("AAA") under its then-current Consumer Arbitration Rules and applicable consumer standards, as modified by these Terms to the extent permitted.
If these Terms conflict with mandatory provisions of the applicable AAA Consumer Arbitration Rules or Consumer Due Process Protocol, the mandatory AAA provisions will control.
Unless the parties agree otherwise, hearings may be conducted remotely where permitted by the applicable AAA rules.
If an in-person hearing is required and the parties cannot agree on a location, the location will be determined under the applicable AAA Consumer Arbitration Rules, taking into account the parties' circumstances and applicable consumer due-process standards.
Nothing in this section requires a consumer to travel to Wyoming solely because Nex Gen Digital Services LLC is organized there.
Either party may bring an individual claim in a small claims court of competent jurisdiction if the claim qualifies and remains within that court's jurisdiction.
This section does not prevent either party from exercising any small-claims option available under the applicable AAA rules.
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, YOU AND NEX GEN DIGITAL SERVICES LLC AGREE THAT ARBITRABLE CLAIMS WILL BE BROUGHT ONLY IN AN INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF, CLASS MEMBER, OR REPRESENTATIVE IN A CLASS, COLLECTIVE, CONSOLIDATED, OR REPRESENTATIVE ACTION.
Unless both parties agree otherwise or applicable law requires otherwise, the arbitrator may not consolidate the claims of different individuals or preside over a class or representative proceeding.
For disputes subject to arbitration, you and Nex Gen Digital Services LLC waive the right to a trial by judge or jury.
If a court determines that a particular claim or request for relief cannot lawfully be arbitrated on an individual basis, that claim or request will proceed in the appropriate court after arbitrable matters are resolved, to the extent permitted by law.
You may opt out of the agreement to arbitrate by sending written notice to support@datingadvice.me within 120 days after the date you first accept these Terms.
Your opt-out notice must include sufficient information to identify your Dating Advice account and a clear statement that you are opting out of the arbitration agreement.
Opting out of arbitration will not affect your ability to use Dating Advice and will not affect any other provision of these Terms.
If you do not opt out within the 120-day period, the arbitration agreement will apply to you to the extent permitted by applicable law.
If substantially similar arbitration demands are filed against Nex Gen Digital Services LLC in a coordinated manner and qualify for treatment under applicable AAA mass-arbitration procedures, the parties agree that the AAA's then-current applicable mass-arbitration rules and procedures may govern administration of those demands.
Nothing in this section eliminates an individual's substantive claim or requires a consumer to waive rights that cannot lawfully be waived.
We may update these Terms from time to time.
If we make material changes, we will provide notice as required by applicable law and update the "Last Updated" date.
Where applicable law requires renewed consent to a material change, we will request that consent.
Changes will apply prospectively as provided in the notice or as otherwise permitted by law.
You may not transfer your rights or obligations under these Terms without our consent except where applicable law provides otherwise.
We may assign or transfer these Terms in connection with a merger, acquisition, reorganization, financing, sale of assets, change of control, transfer to an affiliate or successor, or similar business transaction, subject to applicable law.
If any provision of these Terms is determined to be invalid or unenforceable, that provision will be enforced to the maximum extent permitted or severed where necessary, and the remaining provisions will remain in effect, except where applicable law requires a different result.
Our failure to enforce a provision of these Terms does not waive our right to enforce that provision or any other provision later.
These Terms, together with the Privacy Policy and any additional terms expressly presented for a particular feature or purchase, constitute the agreement between you and Nex Gen Digital Services LLC concerning your use of Dating Advice.
